Consumer Rights - Cancellation, Revocation, and Return Conditions

GENERAL:

  1. When you place an order electronically via the website you are using, you are deemed to have accepted the pre-information form and the distance sales agreement presented to you.

  2. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188), along with other applicable laws regarding the sale and delivery of the products they purchase.

  3. Shipping costs for product delivery will be paid by the buyers.

  4. Each purchased product will be delivered to the person and/or institution at the address specified by the buyer, within 30 days, not exceeding the legal period. If the product is not delivered within this period, buyers may terminate the contract.

  5. The purchased product must be delivered in accordance with the specifications mentioned in the order and, if applicable, with documents such as the warranty certificate, user manual, etc.

  6. In the event that it becomes impossible to sell the purchased product, the seller must inform the buyer in writing about this situation within 3 days of learning of this situation. The full amount must be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT IS NOT PAID:

  1. If the buyer does not pay for the purchased product or cancels the payment in the bank records, the seller’s obligation to deliver the product will be terminated.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

  1. If, after the product is delivered, it is found that the credit card used by the buyer for payment was unlawfully used by unauthorized persons, and the product price is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days at the seller’s expense.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

  1. If there are force majeure reasons beyond the seller’s control, and the product cannot be delivered on time, the buyer will be informed of the situation. The buyer can request cancellation of the order, replacement of the product with a similar one, or a postponement of the delivery until the obstacle is removed. If the buyer cancels the order, the payment will be refunded within 14 days if paid by cash. If the buyer paid by credit card and cancels, the product price will be refunded to the bank within 14 days, although it may take 2-3 weeks for the bank to transfer the amount to the buyer’s account.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  1. The buyer must inspect the product before accepting it from the cargo company; they should not accept the product if it is damaged, broken, or if the packaging is torn. The product will be deemed to have been accepted in good condition. After delivery, the buyer must take care of the product. If the right of withdrawal is to be used, the product must not be used. The product must be returned along with the invoice.

RIGHT OF WITHDRAWAL:

  1. The buyer may exercise the right of withdrawal without any legal or criminal responsibility, and without giving any reason, by rejecting the product within 14 (fourteen) days from the date the product is delivered to the buyer or the person/institution at the specified address.

WITHDRAWAL PERIOD:

  1. If the purchased item is a service, the 14-day period starts from the date of signing the contract. In service contracts where the service is initiated with the consumer’s consent before the expiration of the withdrawal period, the right of withdrawal cannot be used.

  2. The costs arising from the use of the right of withdrawal are the responsibility of the seller.

  3. To exercise the right of withdrawal, the buyer must notify the seller via registered mail, fax, email, or any method specified by the seller within the 14-day period, and the product must not have been used as defined in the "Products Where Right of Withdrawal Cannot Be Used" section of the contract.

USE OF THE RIGHT OF WITHDRAWAL:

  1. The invoice for the product delivered to the buyer or a third party must be returned. (If the invoice for the returned product is corporate, it must be returned with the credit note issued by the company).

  2. The returned product must be delivered with the return form, packaging, and any standard accessories in complete and undamaged condition.

RETURN CONDITIONS:

  1. The seller is obliged to refund the full amount and any documents that place the buyer under debt to the buyer within 10 days from the date the withdrawal notice is received. The seller must receive the returned product within 20 days.

  2. If the value of the product decreases or if it becomes impossible to return due to the fault of the buyer, the buyer is obliged to compensate for the seller’s damages in proportion to their fault. However, the buyer is not responsible for any changes or damages caused by the appropriate use of the product within the withdrawal period.

  3. If the seller’s campaign limit amount is reduced due to the use of the right of withdrawal, the discount amount benefited from the campaign will be canceled.

PRODUCTS WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED:

  1. The following products are exempt from the right of withdrawal:
  • Products prepared according to the buyer’s personal needs or requests.
  • Undeliverable products such as underwear, swimwear, makeup items, perishable items, health and hygiene-sensitive products, mixed products, and periodicals like newspapers and magazines.
  • Products that are immediately delivered in electronic form or intangible goods delivered to the consumer.
  • Products where packaging is opened after delivery, such as cosmetics, personal care products, and office supplies like toner and cartridges.

DEFAULT AND LEGAL CONSEQUENCES:

  1. If the buyer defaults on payments made by credit card, they acknowledge that they will pay interest as per the agreement with the bank and that the bank may take legal action. The seller may claim any resulting legal costs and attorney fees from the buyer.
